1 Acceptance of Terms

By accessing, browsing, registering on, or using Marchaa Genie ("Platform"), the user agrees to be legally bound by these Terms and Conditions, the Privacy Policy, Community Guidelines, Prohibited Items Policy, Refund and Dispute Policy, and all other policies published by Marchaa Genie.

If the user does not agree with these Terms, the user must immediately discontinue use of the Platform.

2 About Marchaa Genie

Marchaa Genie is an online marketplace that enables users to buy, sell, exchange, advertise, and communicate regarding goods and services.

Marchaa Genie acts solely as an intermediary platform and does not:

Inspect products.
Guarantee quality or authenticity.
Participate in user transactions.

3 Eligibility

Users must:

Have legal capacity to enter contracts.
Provide accurate registration information.
Maintain account security.

Marchaa Genie reserves the right to refuse service to any person.

4 User Accounts

Users are responsible for:

Maintaining account confidentiality.
All activities conducted through their accounts.
Promptly notifying Marchaa Genie of unauthorized access.

5 Listings

Users warrant that:

They legally own or are authorized to advertise listed items.
Listings are accurate.
Images are genuine.
Descriptions are not misleading.

Marchaa Genie may remove any listing at its sole discretion.

6 Prohibited Activities

Users shall not:

7 Transactions

Users bear sole responsibility for:

10 Suspension and Termination

11 Intellectual Property

All platform software, trademarks, logos, designs, graphics, and content remain the exclusive property of Marchaa Genie.

Unauthorized use is prohibited.

12 Disclaimer

13 Limitation of Liability

Marchaa Genie shall not be liable for:

Property damage.

Maximum liability shall not exceed PKR 10,000 or the amount paid by the user to Marchaa Genie during the preceding 12 months, whichever is lower.

14 Indemnity

Users agree to indemnify and hold harmless Marchaa Genie, its directors, employees, agents, and affiliates against all claims, damages, losses, liabilities, and legal expenses.

15 Force Majeure

Marchaa Genie shall not be liable for failures caused by:

Natural disasters.
Government actions.
Internet failures.
Cyberattacks.
Power outages.
Strikes.
War.

16 Governing Law

These Terms shall be governed exclusively by the laws of Pakistan.

17 Arbitration

Any dispute shall first be resolved amicably.

If unresolved, disputes shall be referred to arbitration under the Arbitration Act, 1940 of Pakistan.

Seat of Arbitration: Islamabad, Pakistan.

18 Jurisdiction

Subject to arbitration, courts at Islamabad shall have exclusive jurisdiction.
